Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Phyze mobile application ("App") operated by Phyze ("us", "we", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these terms, do not install or use the App.

1. Medical Disclaimer

Phyze is not a medical organization or professional healthcare provider. The fitness programs, AI advice, exercises, and dietary suggestions provided by the App are for informational and educational purposes only. You should consult a physician before starting any fitness program, especially if you have pre-existing health conditions, injuries, or cardiovascular risks. You assume all responsibility for any physical exercises you perform.

2. User Accounts

To use certain features of the App, you must register for an account. You are responsible for safeguarding your login credentials and for any activity under your account. You must notify us immediately of any unauthorized use of your account or security breach.

3. Subscriptions and Billing

Phyze offers premium features (including AI Coaching Chat, advanced metrics, and customized workout generation) under auto-renewing subscription plans. By purchasing a subscription:

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless turned off in your App Store or Google Play account settings at least 24 hours before the end of the current period.
• Payment: Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
• Free Trials: If a subscription comes with a free trial, your account will be charged the subscription price automatically at the end of the trial period unless you cancel at least 24 hours before the trial ends.
• Cancellations and Refunds: You can manage and cancel your subscriptions in your device settings. All refund requests are handled directly by Apple (for iOS users) or Google Play (for Android users) according to their respective policies.
• Forfeiture of Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that service, where applicable.

4. Apple App Store Terms (EULA)

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple. You agree to comply with Apple's standard Licensed Application End User License Agreement (EULA), available at Apple's Standard EULA.

5. Prohibited Uses

You agree not to modify, reverse engineer, decompile, or distribute the App. You also agree not to use the App to send abusive, offensive, or spam messages to our AI Coach services, or bypass any application security controls.

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any personal injury, property damage, lost profits, or indirect damages resulting from your use of the App or reliance on our AI recommendations.
